When the right of withdrawal decays: The right of withdrawal decays totally, due to the lack of the essential condition of integrity of the property (packaging and/or its content and/or tampering), in cases where Ellebizeta ascertains:

1) also partial use of the asset and any consumables.
2) the lack of the external package and/or the original internal packaging.
3) the absence of integral elements of the product (accessories, cables, manuals, parts).
4) The damage of the product for causes other than its transport.
5) Tampering.

As regards the sale of products between professionals (B2B), Ellebizeta implies the following rules:

1) the legal guarantee

With reference to B2B relations it is governed to art. 1490 cc, entitled "Guarantee for the defects of the thing sold", according to which "the seller is required to ensure that the thing sold is immune to vices that make it unsuitable for the use to which they are destined or decrease its value appreciable".

In B2C relations, the discipline is found in art. 129 CDC (conformity to the contract) according to which "the seller has the obligation to deliver goods to the consumer in accordance with the sales contract". In order for assets to be considered such it is necessary that:

a) they are suitable for the use to which usually serve assets of the same type;
b) comply with the description made by the seller and have the qualities of the good that the seller presented to the consumer as sample or model;
c) present the quality and usual performance of an asset of the same type, that the consumer can reasonably expect, taking into account the nature of the property and, if necessary, of the public declarations on the specific characteristics of the goods made in this regard by the seller, producer or by his agent or representative, in particular in advertising or on the labeling;
d) are also suitable for the particular use wanted by the consumer and that he was brought to them to the knowledge of the seller at the time of the conclusion of the contract and that the seller has also accepted for conclusive facts.

2) Conventional guarantee

The legal guarantee for the defects of the thing sold can with a specific contractual clause to be modified in order to increase or decrease the guarantee itself "(Cass. n. 8578/97),

In B2B relationships
Art. 1487 cc provides that "contractors can increase or decrease the effects of the guarantee and can also agree that the seller is not subject to any guarantee".
